Terms of Use

Plain-language terms for Athlete Select LLC. Effective and last updated August 31, 2026 (version 2026-08-31-2).

1. Acceptance of these terms

These Terms of Use are an agreement between you and the operator of Athlete Select LLC(“Athlete Select”, “we”, “us”), covering getathleteselect.com and the matching tools on it. By using the site you accept these terms. If you do not accept them, please do not use the service.

2. Eligibility — adults only

The service is intended for adults: a parent, legal guardian, coach or other adult acting on behalf of an athlete. You must be at least 18 years old and legally able to enter this agreement. Accounts and profiles belong to the adult, never to a child, and we do not offer child accounts. You are responsible for the information you submit and for supervising any minor who uses equipment you purchase.

3. What the service is

Athlete Select is an independent sports-equipment matching and purchase-intelligence platform. The current release covers baseball and fastpitch softball bats and gloves. You describe the athlete using the fit information each equipment type requires, and a deterministic engine produces a suggested specification and, where the verified catalog supports it, exact product options. We are not a store: we do not sell equipment, take orders, take payment, ship product or handle returns.

4. Recommendations are informational

Recommendations, fit scores, confidence labels and written explanations are informational decision support only. They are not professional coaching, medical, safety, legal, league-official or manufacturer advice. Sizing is a documented heuristic built from multi-source manufacturer guidance and the answers you provide — not a laboratory measurement. See the recommendation, safety and league-eligibility disclaimer for the full detail, which forms part of these terms.

5. No guarantees

We do not guarantee fit, comfort, performance, results, safety, injury prevention, durability, product availability, price, or eligibility under the rules of any league, tournament, association or governing body. Product data can be incomplete or change without notice, and manufacturers can revise specifications, certifications and model lines at any time.

6. Your responsibility to verify

Before you buy or allow an athlete to use a bat, you are responsible for verifying the exact model and variant, model year, length and drop, the certification stamp on the bat itself, the manufacturer’s own sizing and use guidance, physical condition, and the current rules of every league and tournament your athlete plays in. Local rules can be stricter than USSSA rules and can change mid-season.

7. Third-party retailers and links

The site may link to third-party retailers, marketplaces and manufacturer pages. Those businesses are independent of us. Any purchase is a transaction between you and that third party under their terms, pricing, shipping, warranty, condition description and return policy. We do not control their content or accuracy, we do not inspect any listed item, and we are not a party to your purchase. Price and availability shown on our pages are a point-in-time observation and may be out of date; the retailer’s own page is authoritative.

8. Affiliate relationships

Some outbound retailer links may be affiliate links, meaning we may earn a commission on a qualifying purchase at no additional cost to you. Full detail is in the affiliate and advertising disclosure.

9. Independence of rankings

Commission, commission rate, sponsorship, retailer payout, click revenue and advertising spend are not inputs to the recommendation engine and never determine which bat is recommended, its fit score, or its position in a result. We may recommend keeping the athlete’s current equipment.

10. Intellectual property

Except for third-party marks, product specifications, images, and other materials identified as belonging to someone else, Athlete Select LLC owns or licenses the Athlete Select website and app, its original text and graphics, the recommendation-engine implementation, the scoring and rules implementation, original databases and compilations (including their structure and organization), catalog curation, documentation, methodology descriptions, and other proprietary materials. Those works are protected by copyright, trademark, trade-dress, database, and other intellectual-property laws. Brand names, model names, logos, trademarks, manufacturer specifications, product images, and retailer content referenced on the site belong to their respective owners; their use is for identification only and does not imply endorsement, partnership, or affiliation. We do not claim ownership of manufacturer specifications, product images, trademarks, model names, retailer content, open-source components, or the technology provided by our platform and hosting providers.Athlete Select LLC grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the service for your own non-commercial equipment decisions. No other rights are granted. You may not reproduce, modify, distribute, publicly display, create derivative works from, reverse engineer, scrape, or systematically extract any part of the service or its proprietary materials without our prior written permission.

11. Feedback and ideas

If you voluntarily send us suggestions, ideas, feedback, or other comments about the service, you grant Athlete Select LLC a perpetual, irrevocable, worldwide, royalty-free, sublicensable right to use, modify, and incorporate them into the service or any related products without restriction or compensation to you. This does not transfer ownership of any intellectual property you already owned before sending it, and you represent that you have the right to share what you send.

12. Acceptable use

Do not scrape, crawl, bulk-download or systematically copy the catalog or scoring output; do not resell, republish or create a derivative service from it; do not reverse engineer, probe or interfere with the service or its security; do not submit false, unlawful or abusive content; do not submit a child’s name, date of birth, contact details, photo, school or team, or any other personal information we do not ask for; do not attempt to access administrative areas or other users’ data; and do not use automated systems in a way that degrades the service.

13. Availability and changes to the service

The service is in beta. Features, catalog coverage, rules data and scoring may change, be suspended or be withdrawn at any time, and defects and downtime are possible. We may modify or discontinue any part of the service without notice.

14. Disclaimers

To the maximum extent permitted by law, the service and all content are provided “as is” and “as available” without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted availability.

15. Limitation of liability

To the maximum extent permitted by law, Athlete Select LLC and its members will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, purchase decisions, equipment that does not suit an athlete, league or tournament eligibility outcomes, injury arising from equipment use or misuse, or third-party retailer transactions. Where liability cannot be excluded, our total aggregate liability for all claims relating to the service is limited to the greater of the amount you paid us for the service (which is currently zero) or one hundred U.S. dollars. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

16. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Athlete Select LLC and its members from third-party claims, losses and reasonable costs arising from your misuse of the service, your breach of these terms, information you submit, or your purchase or use of equipment.

17. Termination

We may suspend or end your access to the service at any time, including for breach of these terms or conduct that risks the service or other users. You may stop using the service at any time. Sections that by their nature should survive — intellectual property, feedback and ideas, disclaimers, limitation of liability, indemnity and governing law — survive termination.

18. Governing law

These terms are governed by the laws of the United States and of the U.S. state in which the operator of Athlete Select LLC is established — Kansas — without regard to conflict-of-laws rules. Disputes will be brought in the state or federal courts of that state, except where applicable law gives you a non-waivable right to another forum.

19. Severability and entire agreement

If any provision is held unenforceable, the remainder stays in force and the unenforceable provision is applied as narrowly as necessary. These terms, together with the privacy policy, the affiliate disclosure and the recommendation disclaimer, are the whole agreement about the service. A failure to enforce a provision is not a waiver of it.

20. Changes to these terms

We may update these terms. The effective date at the top of this page changes when we do, and continued use after that date means you accept the updated terms.
